Terms of Service

These Terms of Service ("Terms") govern your access to and use of Dailera, the personal AI agent platform provided by Dailera, Inc. ("Dailera, Inc.", "we", "us", or "our"), including our website, our hosted dashboard, and our Telegram bot (collectively, the "Service"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you don't agree, don't use the Service.

1. Description of the Service

Dailera is a personal AI agent that you connect to your own apps and accounts. Once connected, it can read and act on your behalf across the tools you authorize, hold vector memory of things it learns about you, join and transcribe meetings on your calendar, and correspond with you over web chat and Telegram. You control which capabilities are enabled and which third-party accounts are connected.

2. Eligibility and Accounts

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. You're responsible for maintaining the security of your account credentials and for all activity that happens under your account. Notify us immediately if you suspect unauthorized access.

3. Connected Accounts and Third-Party Services

Dailera connects to third-party apps and services (such as email, calendar, chat, and productivity tools) through Composio, our connected-account infrastructure provider, using OAuth. We never see or store your third-party passwords. Each connection is scoped to specific permissions, and you can revoke any connection at any time from your dashboard. Your use of any connected third-party service remains subject to that service's own terms, and we are not responsible for the availability, accuracy, or conduct of third-party services.

4. Agent Actions Taken on Your Behalf

The agent is designed to act autonomously within the boundaries you configure, including sending messages, scheduling, saving memories, and using connected tools. You are responsible for reviewing the capabilities you enable and for the consequences of actions the agent takes using your connected accounts. Certain higher-risk actions, such as corresponding with new external parties, are gated behind explicit approval flows, but you remain responsible for supervising your agent's configuration and behavior.

5. Meetings, Recording, and Transcription

If you enable meeting notes, a meeting bot joins calls on your calendar to record audio and generate transcripts and summaries. Recording laws vary by jurisdiction, and many require the consent of all participants before a call can be recorded. You are solely responsible for obtaining any consent required by law before enabling this feature or inviting the bot into a call, and for complying with the recording and wiretapping laws applicable to you and your meeting participants.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or the rights of a third party;
• Send unsolicited bulk communications or otherwise abuse a connected account's messaging capabilities;
• Attempt to bypass, disable, or interfere with the Service's security, rate limits, or safety controls, including prompt injection or other attempts to manipulate the agent into acting outside its intended guardrails;
• Reverse engineer or misuse the Service to build a competing product; or
• Use the Service to process content you don't have the right to process, or on behalf of someone who hasn't consented to it.

7. Credits, Billing, and Plans

Hosted use of Dailera is metered by credits, which are consumed as the agent performs work (for example, model calls and tool executions). Paid plans and credit top-ups are billed through our payment processor. Fees are non-refundable except where required by law. We may change pricing or plan structures with notice; continued use of the Service after a change takes effect constitutes acceptance of the new pricing.

8. Self-Hosted Deployments

Dailera can also be self-hosted on your own infrastructure using your own API keys and database. These Terms govern your use of our hosted Service (dailera.com and its subdomains); a self-hosted deployment runs entirely under your control and is instead governed by the license included in the project's source code repository. We provide the self-hosted software "as is" and have no visibility into, or responsibility for, data processed by a self-hosted instance.

9. Third-Party AI Providers

Model inference is routed through third-party AI providers, including Anthropic. Provider terms and data-handling practices apply to the processing they perform on our behalf. See our Privacy Policy for details on how content is handled during inference.

10. Intellectual Property

We own the Service, including its software, design, and trademarks. You retain ownership of the content you provide to the Service and the outputs generated for you. You grant us a limited license to process your content solely to operate and improve the Service on your behalf.

11. Disclaimers

The Service, including all agent outputs, is provided "as is" without warranties of any kind. AI-generated content can be inaccurate or incomplete. You're responsible for reviewing agent outputs before relying on them for consequential decisions, especially anything sent externally under your name.

12. Limitation of Liability

To the maximum extent permitted by law, Dailera, Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months preceding the claim.

13. Termination

You may stop using the Service and delete your account at any time, which permanently deletes your instance and its associated data. We may suspend or terminate access for violations of these Terms or to protect the Service and its users.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify you directly. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the jurisdiction in which Dailera, Inc. is organized, without regard to conflict-of-law principles.
